Please read carefully: where enforceable, you and we agree to binding individual arbitration instead of a jury trial or class action. This applies to disputes relating to these terms or the service after you accept this version, subject to the exceptions below.
Informal resolution: send a written description of your dispute and requested relief to hello@mostvaluablelink.com. We will try in good faith to resolve it for 30 days. This process does not prevent urgent relief, a small claims filing, a regulator complaint or a filing needed to preserve a legal deadline.
Arbitration: unresolved disputes are administered by the American Arbitration Association (AAA) before one arbitrator under its applicable Consumer Arbitration Rules for consumer disputes or Commercial Arbitration Rules for business disputes. The Federal Arbitration Act governs this clause. Current rules and fees are available at adr.org. Consumer fees, hearing arrangements and relief must comply with AAA rules and its consumer due process requirements; we pay the business fees those rules require.
A hearing may take place remotely by agreement or as allowed by the applicable rules. An in-person consumer hearing will take place at a reasonably convenient location under those rules. The arbitrator may award the individual relief a court could. If AAA will not administer a claim because of our failure to satisfy its requirements, you may take it to court.
Individual claims: to the extent permitted, claims must be brought individually, not as part of a class, collective or representative action, and the arbitrator cannot consolidate different people’s claims without all parties’ agreement. Neither party waives non-waivable public injunctive relief or other mandatory rights. A claim or remedy that cannot lawfully be arbitrated proceeds in a competent court; the remainder may proceed in arbitration.
Exceptions: either party may use a competent small claims court or seek urgent court relief against intellectual property infringement or unauthorised access. Nothing prevents a complaint to a public authority. If a court claim proceeds and local law permits, both parties waive trial by jury.
Opt out: within 30 days after first accepting this arbitration provision, email hello@mostvaluablelink.com with “Arbitration opt-out” and enough information to identify your submission or checkout email. Opting out of arbitration and the class waiver does not affect other terms or your listings. Changes do not retroactively apply this clause to existing disputes or override an earlier valid opt-out.
